Black Country Enterprise Zone: Darlaston Local Development Order 2015

Sections 61A – 61D and Schedule 4A of the Town and Country Planning Act 1990 (as amended) and Article 34 of the Town and Country Planning (Development Management Procedure) (England) Order 2010

The Black Country Enterprise Zone (EZ) includes several sites within the Darlaston area. The aims of the EZ are to encourage economic growth, attract new businesses and create jobs. A requirement of EZ status is that a simplified planning system is put in place and on this basis the Council adopted a Local Development Order (LDO) in April 2012. This LDO applied to the EZ sites and surrounding land and allowed certain development to be undertaken without the need for specific planning consent being obtained.

The adopted LDO had a lifespan of 3 years and expired on 15 April 2015. On this basis, prior to this date a revised and updated LDO was prepared and this was adopted by the Council’s Cabinet on 18 March 2015. The Darlaston Local Development Order 2015 therefore came into force upon expiry of the existing Order on 16 April 2015.

The Darlaston Local Development Order 2015 authorises development for research and development, light industry, general industry and storage and distribution uses across the overall area, as well as development for the re-use and re-cycling of non-hazardous, non-organic waste enclosed within permanent buildings within a defined sub-zone.

However, for a development proposal to be in compliance with the LDO it must be in line with the restrictions and limitations (set out in Schedule 2) relating to:

  • change of use and/or enlargement of existing buildings
  • height and/or floorspace of any new buildings
  • demolition of buildings
  • minor works

To enable the Council to assess whether a proposal falls within the scope of the LDO a developer is required to submit details of the development as part of a pre-information process (PIP) set out in Schedule 3. Required details include site layout and elevation drawings, as well as information on drainage, flood risk, traffic generation, air quality, noise and ecology. The Council will then consult the relevant statutory agencies and stakeholders and within 28 days of the acknowledgement of submission of a pre-information form confirm whether the proposed development is permitted under the LDO.

If the Council considers that the proposal is permitted under the LDO then development can take place, but only in accordance with conditions as set out in Schedule 4.

Any development proposal that is considered to be outside the scope of the LDO will not be authorised and the applicant will be required to submit a formal planning application in the normal manner to allow all relevant issues to be assessed.
